When you upload a video to vzaar you agree to abide by our Terms and Conditions. For the purposes of these Terms and Conditions, if you have registered for a log-in to an account at vzaar.com or have access to your organisation’s vzaar account or if you are the person who authorises or makes payment for your organisation’s vzaar account, then you are considered a Subscriber (referred to as “you”).
What vzaar is For And What We Hope You Do
Vzaar is for businesses who want to upload videos and stream them on the Internet to their clients, prospects and subscribers.
What We Don’t Want You To Do
We don’t want you using vzaar to upload bad videos or use your videos in a bad way. We don’t like content that:
- Violates UK law or the law of the jurisdiction under which you operate;
- Infringes any third party’s copyrights or other rights (e.g., trademark, privacy rights, etc.);
- Contains sexually abusive content, exploits minors; depicts unlawful acts or extreme violence;
- Contains hateful, defamatory, or discriminatory content or incites hatred against any individual or group;
- Depicts animal cruelty or extreme violence towards animals;
- If you do upload a video that is unsuitable we reserve the right to remove that video. In extreme cases or, for persistent infringing behaviour, we may suspend your account and prohibit further use of the vzaar service. We’ll contact you directly and explain any action we take.
We reserve the right to require Subscribers with videos or accounts that contain lawful but explicit sexual or violent content, to subscribe to our Adult Launch Plan (or equivalent) and to set their content to Private.
No failure or delay by vzaar in exercising any of our rights in this Agreement will waive any further exercise of that right.
Our plans have bandwidth and storage limits. We reserve the right to limit subscribers who are exceeding their account bandwidth limits.
If you are using the free trial service and you surpass 100% of your allocated allowance without upgrading you will be considered to be contravening our fair use policy. If you do not upgrade your trial account to a paid subscription, we reserve the right to automatically replace your videos with an upgrade message. We do not want you to open multiple trial accounts in order to circumnavigate the allowances and will regard such action as being in breach of our fair use policy and may suspend you from the site.
It is your responsibility to track the usage of bandwidth and storage for your account and act accordingly. Subscribers will be emailed when their bandwidth usage reaches 80% and 100% of their plan limit. You can track your usage of bandwidth and storage at any time by logging in to the Statistics page. Subscribers who exceed 100% of their allocated bandwidth allowance will be emailed with notification of how to upgrade to an appropriate plan. Subscribers who exceed 100% of their allocated storage allowance will be charged for overages. Continuing infringement of this allowance will result in the video content being replaced with an upgrade message.
How We’ll Communicate With You
We have requested your email address so that, if we need to, we can get in touch with you regarding your account. By signing up you are giving us permission to email you updates on the vzaar service and to contact you individually should the need arise.
You consent to receive all communications including notices, agreements, disclosures, or other information from vzaar electronically.
If you don’t want us to, we won’t send you any marketing emails or newsletters. You simply need to opt out by clicking on the unsubscribe link in our newsletters or on the Profile page of your vzaar account.
You made your video, so you retain all of your ownership rights in your content. You are solely responsible for your own content and the consequences of posting or publishing it. vzaar expressly disclaims any and all liability in connection with your content.
If you have selected the privacy option, or if you tell us you don’t want us to, we won’t use your video for any marketing activities.
But we do like to show off good videos, perhaps by promoting them on our site, in our blog or including them in our newsletters. We reserve the right to use a copy (so as not to generate plays on your account) of videos you have uploaded in our blog, newsletters or when we’re talking to journalists and reporters, to give them a flavour of vzaar, unless you’ve set the video to Private, or you’ve asked us not to do so.
You can find full and up-to-date details of vzaar’s plans here. We reserve the right to change and update our plans without notice. When we do we reserve the right to release the revised plans to existing clients progressively over the course of up to 60 days.
Our payments process works as follows:
- You are billed a pro-rated charge for the first, partial month of service.
- You are then billed on the 1st of the following month for your full monthly or annual plan.
- Monthly plans are then billed on the 1st of each month thereafter.
- Your subscription will continue to renew automatically, using the payment method on file, every month or every year until you upgrade, downgrade or cancel.
- Bandwidth limits are reset on the 1st of every month.

For annual subscriptions we are usually happy to issue an invoice on 14 day terms, on request; with payment via bank transfer or cheque. When you subscribe to an annual subscription you commit to a year of service and receive a discount. You’re free to downgrade your subscription but balances will be applied to your account as credit rather than being refunded.
For monthly and annual payments, we accept payment in US dollars, British Pounds, Euros or Australian dollars via credit cards or PayPal.
Refunds And Cancellations
You are free to cancel or downgrade your paid plan at any time. This can be done via the Accounts page. We will not refund subscriptions that have already been paid. We will refund any bills raised in error if notified within 30 days.
This is particularly important for customers who subscribe annually. When you choose an annual subscription you receive a discount over the monthly cost and, in return, you are committing to a full year of service. We are not able to offer refunds on annual subscriptions which are canceled mid-cycle.
vzaar will store your target videos until you delete the video or terminate your account.
You source videos will be saved for 30 days, unless you turn on the option to keep them. You can find the Source Storage settings on the add-ons page of your account.
Deleted videos will be removed by batch processes after 30 days.
Deleting Your Account And Videos
You can request us to delete your account and all your videos at any time via the Settings page. We’ll delete your account within 7 days.
You indemnify, defend, and hold harmless vzaar and its directors and employees, from and against all third party actions that: (i) arise from your content on the vzaar platform (ii) assert a violation by you of any term of this Agreement; or (iii) assert that any content you hosted on the vzaar platform violates any law or infringes any third party right, including any intellectual property or privacy right.
This Agreement shall be governed by the laws of England.
